General Guarantee Terms

GENERAL GUARANTEE TERMS
FOR BUYERS THAT ARE NOT CONSUMERS

1. LED Labs ensures that the products offered by it are free from hidden defects.
 
2. The guarantee period is generally 24 months. The guarantee period may be longer for some products. In this case, information about the guarantee period shall be included in the packaging of a given product or in the catalogue card available on the LED Labs website at: www.led-labs.pl. The guarantee period runs from the date the product is delivered to the buyer directly by LED Labs.
 
3. The guarantee is provided only to the buyer purchasing products directly from LED Labs. It may not be transferred to other entities.
 
4. The buyer acquires the rights resulting from the guarantee provided that the full price of the purchased products is paid to LED Labs.
 
5. The guarantee covers only physical defects of the products that occurred during the guarantee period and which arose for reasons existing in the product when it was sold, after which time the risk of accidental damage and loss of goods was transferred to the buyer (i.e. usually at the time of delivery). The guarantee covers only defects related to the functional properties of items and if loss of function occurs after ordinary use.
 
6. The guarantee does not cover, in particular, defects resulting from improper use, assembly, independent modifications or repairs made inconsistently with the instructions for use or contrary to technical knowledge. The guarantee does not cover defects resulting from improper transport, storage or maintenance of products, as well as mechanical damage resulting from accidents, natural disasters, unusual conditions of use or storage, such as high temperature, pressure, humidity, contact with chemical agents, etc. The guarantee does not apply to products used contrary to the manuals or not in accordance with their intended use.
 
7. The guarantee does not cover changes in the characteristics of the products resulting from normal wear and tear over time. Due to the physical and chemical properties of light emitting diodes (LEDs), it is to be expected that the luminous intensity decreases by up to 30% of its original value and/or the light colour changes slightly while using and with the passing of time.
 
8. In the event of a defect, the buyer shall submit a complaint to LED Labs in writing or via e-mail. The complaint shall be submitted within 14 days from the date of finding the defect, or else the rights under the guarantee are lost by the buyer. The complaint shall include a designation of the defective product and a description of the defect.
 
9. LED Labs will consider and respond to the complaint within 14 working days. However, if it is necessary to obtain additional explanations, technical expertise or check the defective product: the deadline may be extended, about which LED Labs shall inform the buyer, indicating a new date by which the complaint will be considered.
 
10. LED Labs may require the buyer to provide additional information, materials or documentation, in particular to send a photo of the defective product or a document confirming the purchase of the product. Failure to submit the requested materials may result in the extension of the complaint considering procedure.
 
11. If it becomes necessary to examine the defective product, the buyer shall deliver the defective product to LED Labs and cover the cost of its transport, unless the parties agree otherwise. In this case, if the complaint is found justified, LED Labs shall reimburse the buyer for the documented transport costs. If the complaint is unjustified, LED Labs shall not be obliged to reimburse the transport costs or cover the cost of returning the product to the buyer. The buyer bears the risk of accidental loss or damage to the product until it is delivered to LED Labs and from the moment the returned product is provided to the courier or directly to the buyer.
 
12. If the complaint is considered justified, LED Labs shall, at its own discretion, fix the defect of the product (repair it), provide the buyer with a new product free from defects (replace it) or refund the price of the product paid by the buyer.
 
13. LED Labs shall perform its obligation to repair or replace the product, or refund the price paid, within 15 working days from the date of recognising the buyer's complaint as justified. However, in the event of supply difficulties, this period may be extended, about which LED Labs shall inform the buyer, indicating a new date by which the complaint will be considered.
 
14. If the product is repaired or replaced, the guarantee period shall neither be extended nor resumed.
 
15. LED Labs shall not be held responsible either by the direct buyer, or by any third party users, for any damages, expenses or lost profits resulting from the purchase, use or inability to use the product.

16. The General Guarantee Terms are valid from July 1, 2020.
 
17. All contracts accepted on the basis of these GGT are subject to Polish law. The provisions of the Civil Code and relevant acts shall apply in matters not covered by the GGT.
 
18. In the case of doubts as to the interpretation of the provisions of the GGT, the Polish language version shall prevail.
 
19. The parties oblige to endeavour to resolve any disputes arising from their contracts amicably. If the dispute cannot be resolved amicably, the competent court shall be the Polish court with jurisdiction over the registered office of LED Labs.
